Regular Monthly Meeting
January 11, 2010

The regular monthly meeting for the month of January was called to order at 6:00 p.m. by the Honorable Mayor Dr. Clemontine F. Washington.
Members present: Curtes H. Roberts, Sr., Mayor Pro-Tem; Levern Clancy, Jr., Councilman; Melice H. Hamilton, Councilwoman; and Terrence Doyle, Councilman.

Mayor Washington introduced all officials for the new administration.

Invocation by the Rev. Doug Walker, Pastor of Midway United Methodist Church.

Pledge of Allegiance to the United States Flag led by Ms. Charzetta Quarterman a Liberty County High School student.

Approval of Agenda – Mrs. Debra Attical petitioned to add the Notice of Zoning Ordinance Revisions to Article III 24.3 Section 31 to the agenda. Mayor Washington petitioned to add Executive Session due to an emergency to discuss pending litigation. Councilman Clancy made a motion to added executive session to the agenda. Councilman Doyle seconded the motion. Councilman Roberts made the motion to approve the agenda adding the petitioned items. Councilwoman Hamilton seconded the motion. The motion was passed unanimously.

Approval of Minutes- December 14, 2009 – It was moved by Councilman Doyle and seconded by Councilman Curtes H. Roberts, Sr. to adopt the minutes as written. This motion passed unanimously.

New Business

Mrs. Sara Swida - Keep Liberty Beautiful – Mrs. Swida presented the Midway City Council with 2010 Calendars and the winter through spring itinerary of the upcoming events. Mrs. Swida stated that she look forward to working with the officials. January 09, 2010 was bringing a tree to the chipper, 770 trees were collected, and over 2500 pounds of old telephone books will be donated by Centurylinks. Approximately 160 trees will be planted on Arbor Day. Mrs. Swida stated that her new office is located in the rear of the Midway Civic Center and the new telephone number is (912) 880-4888. Councilman Doyle complimented Mrs. Swida on her accomplishments during 2009 1st Place State Affiliate Award from Keep Georgia Beautiful; 2nd Place National Award in Litter Prevention for Read Across Liberty goes Green from Keep Liberty County Beautiful; and 2nd Place National Award in Waste Reduction and recycling for World’s Largest Crayon from Keep America Beautiful.

LCPC Presentations – Mrs. Debra Attical, Zoning Administrator
Mrs. Attical introduced the Liberty Consolidated Planning Commission staff that was present Mr. Abe Nadji the Director of Engineer and Mrs. Gabriel Hartege the Asst. Zoning Director.

1. Personal Touch Tax Service Occupational License – Mrs. Linda Goggins is the owner. The business is located at 132-A Martin Rd. in Buddy Holton’s Plaza. Mrs. Attical stated that LCPC recommends approval. The existing property is zoned commercial. Mayor Washington stated that the application does not have a federal identification number. Councilman Clancy recommended not granting the license until additional information is completed. Councilman Doyle seconded. Councilwoman Hamilton and Councilman Roberts voted for approval. Mayor Washington broke the tie. The business license was approved.

2. Shrimp Shack II Occupational License – Mr. James and Joy Wotring are the owners. The business is located at 60 Butler Ave Unit #3 in Topi Trail Plaza LLC. Mrs. Attical stated that the Agricultural License can’t be approved until the Occupational License is approved. Mrs. Attical stated that LCPC recommends approval. Councilwoman Hamilton made a motion to approve the occupational license. Councilman Doyle seconded. This motion passed unanimously.

3. Cole & Sons Mobile Detailing Occupational License – Mr. Darnell B. Cole, Jr. is the owner. This is a mobile business. Mrs. Attical stated that LCPC made recommendations to Mr. Cole and approval is pending.

4. Robert Pringle Special Exception 2009-047-MW – Mr. Robert Pringle is the Owner. This property is located at map and parcel 241C 007. Petitioner Robert Pringle request to table Special Exception 2009-047-MW. Councilman Doyle made the motion to table
the Robert Pringle Special Exception 2009-047-MW. Councilman Roberts seconded. This motion passed unanimously.

5. East Wood Village – Open Public Hearing
Councilman Clancy made the motion to open the public hearing. Councilman Roberts seconded the motion. This motion passed unanimously.
Mrs. Attical presented Rezoning Petitions: 2009-053, 054, 055 MW, The Eastwood Village Subdivision. Rezoning petition: 2009-053-MW Request submitted by George and Susan Haray owners of Parcel 241A 107 which contain 12,237 sq ft. of uplands, located on Ole Cottage Lane. Rezoning petition: 2009-054-MW Request submitted by The Mulberry Company, LLC owners of the remaining subdivision parcels except parcel 109. Rezoning petition: 2009-055-MW Request submitted by Bryan Bank & Trust, owners of parcel 241 A 115, located on Veranda Trail within Eastwood Village Subdivision, the lot contains .28 acres of upland more or less. The owners request to rezone the parcels from R-1 (Single Family Dwelling District) to R-2 (Single Family Dwelling District) for the purpose of changing the front yard setback from thirty-five (35) feet to twenty-five (25) feet. Note ** Excludes lot 16 (parcel 241A 109) ** Add to the areas requesting rezoning parcel 241A 085** Trent Long, County Engineer stated to have a larger rear yards and to build houses similar to those located in Hickory Hill Subdivision. Mr. Long stated this would bring some of the lots back into compliance. Councilman Clancy made to motion to close the public hearing. Councilwoman Hamilton seconded the motion. This motion passed unanimously.

Rezoning petition: 2009-053-MW Councilman Doyle made a motion to table this request until parcel 241A 109 is included. Councilman Roberts seconded the motion. This motion passed unanimously.

Rezoning petition: 2009-054-MW Councilman Doyle made a motion to table this request until parcel 241A is included. Councilman Clancy seconded the motion. This motion passed unanimously.

Rezoning petition: 2009-055-MW Councilman Doyle made a motion to table this request until parcel 241A is included. Councilman Clancy seconded the motion. This motion passed unanimously.

Notice of Zoning Ordinance Revisions to Article III Section 24.3 Number if parking spaces required and Section 31 Shopping Centers
Public Hearing – Councilman Clancy made the motion to approve the public hearing opening. Councilman Roberts seconded the motion. This motion passed unanimously. Mrs. Attical presented the two principle changes to the Zoning Ordinance (attached). Councilman Roberts made a motion to table the Zoning Revisions to Article III Section 24.3 until the next meeting. Councilman Doyle seconded the motion. This motion passed unanimously.

Mattie Hicks Scholarship Fund – Mayor Washington informed the Council that Mrs. Hicks was funeralized on January 05, 2010 and the family requested in lieu of flowers to please donated to the Mattie Hicks Scholarship Fund. Councilman Clancy made the motion and withdrew it. City Attorney Richard Braun, Jr. stated that he would explain later.

MLK Observance Day Activities - Mayor Washington explained the time, date and place to meet if you would like to participate with the activities to include the parade line-up on Monday, January 18, 2010 at 8:30 a.m.

Election of Mayor Pro-Tem – Mayor Washington stated that the Mayor Pro-Tem will serve in the absence of the Mayor. This person will be working very close with the Mayor. Councilman Doyle stated this is a demanding position. Councilman Doyle nominated Councilman Robert. Councilman Clancy nominated himself. Mayor Washington called for a vote.
Councilman Clancy received one (1) vote, and Councilman Roberts received three (3) votes. Councilman Roberts will be the Mayor Pro-Tem.

Mayor Washington thanked everyone for attending the first council meeting of the new elected officials serving 2010-2013.

Announcements – Mrs. Angela Thomas stated that W.A.R.M. is embarking on their six annual events. It will be on January 23, 2010 at Midway Civic Center Individuals in need of food and household items will be saved. The Civic Center will be open at 7:00 a.m. for volunteers and distribution begins at 9:00 a.m.

Executive Session – At 7:20 p.m. Councilman Clancy made the motion to go into executive session to discuss litigation. Mayor Pro-Tem Roberts seconded the motion. This motion passed unanimously. Mayor Pro-Tem Roberts made the motion to adjourn executive session at 7:36 p.m. Councilwoman Hamilton seconded the motion. This motion passed unanimously

Adjourn – Mayor Pro-Tem Roberts made the motion to adjourn the meeting at 7:39 p.m. This motion was seconded by Councilwoman Hamilton. This motion passed unanimously.
