Official Minutes of the Midway City Council
Regular Monthly Meeting
May 10, 2010

The regular monthly meeting for the month of May was called to order at 6:00 p.m. by the Honorable Mayor Dr. Clemontine F. Washington.

Members present: Curtes H. Roberts, Sr., Mayor Pro-Tem; Terrence Doyle, Councilman; Levern Clancy, Jr., Councilman; and Melice H. Hamilton, Councilman.

Mayor Washington greeted the audience.

The invocation was given by Councilman Terrence Doyle.

Pledge of Allegiance to the United States Flag was led by Master Christopher Smith, a Midway Middle School student.

Approval of Agenda – Mayor Washington requested the following item 7-A- 1 to be moved up to Item 6-C- 2, and Christopher Smith to be added and placed at 7-A-1. Councilman Clancy made the motion to approve the agenda with the necessary correction and changes. Mayor Pro-Tem Roberts seconded the motion. This motion passed unanimously.

Approval of Minutes – Councilman Doyle made several corrections. Councilman Doyle made the motion to approve the minutes of the March 08, 2010 minutes with the corrections. Councilman Clancy seconded the motion. This motion passed unanimously. Councilwoman Hamilton made the motion to approve the April 12, 2010 minutes with corrections. Mayor Pro-Tem Roberts seconded the motion. This motion passed unanimously.

Amendment to Midway Fire Ordinance Chapter: Article A-Sec. 3-2-3 –Councilman Doyle had a concern on the home alarms going off due to negligence or by malfunction of the alarm. Councilwoman Hamilton replied it’s not to deter the residents. Mayor Pro-Tem Roberts stated it’s not about private home owners, but it’s to deter businesses and to discourage excessive false alarms by all. Councilman Doyle made the motion to open the public hearing. Mayor Pro-Tem Roberts seconded the motion. This motion passed unanimously. Mr. Arthur Guthrie, a resident, suggested the fine not exceed $2,000.00; Mrs. Attical suggested that the fees be upgraded; Ms. Gwendolyn Lowe concurred with Mrs. Attical. Councilman Doyle made the motion to close the public hearing. Councilman Clancy seconded the motion. This motion passed unanimously. Mayor Washington stated this matter will be addressed at the May 24, 2010 work session. Councilman Doyle made the motion to postpone the Amendment to Midway Fire Ordinance Chapter: Article A-Sec. 3-2-3 – until the June 14, 2010 meeting. Mayor Pro-Tem Roberts seconded the motion. Councilwoman Hamilton and Councilman Clancy voted against. Mayor Washington breaks the tie. The motion passes.

Linda Adelman – Sign Permit – Mrs. Gabriel Hartage, LCPC Assistant Zoning Administrator presented copies of the sign permit zoning approval transmittal. Mrs. Hartage stated Mrs. Adelman could not make it due to illness. She also stated the sign is in the original location. There are two other signs in the same location. The new sign is approximately 2 feet on the right-of-way. Mrs. Hartage recommended that the sign be moved out of the right-of-way. The sign will have to be moved approximately 4 feet out of the right-of-way to be in compliance with the city ordinances. Councilman Clancy made the motion to disapprove until the recommendation has been met. Mayor Pro-Tem Roberts seconded that motion. This motion passed unanimously.

Resolution to amend the Service Delivery Strategy (Liberty County) - Mrs. Alissa Davis, LCPC Assistant Transportation Planner, presented the map (revised April 26, 2010) of the proposed service delivery area and a Resolution to Amend the Service Delivery Strategy. Mr. Paul Simonton, owner of P. C. Simonton and Associates, Inc. explained where the county lines will be located. Councilman Clancy made the motion adopt the Resolution to amend the Service Delivery Strategy (Liberty County) as recommended by Liberty Consolidated Planning Commission. Councilwoman Hamilton seconded the motion. This motion passed unanimously.

Resolution to amend the Service Delivery Strategy (Midway) – Mrs. Davis presented the map (revised April 26, 2010) of the proposed service delivery area and a Resolution to Amend the Service Delivery Strategy. Councilwoman Hamilton made the motion to adopt the Resolution to amend the Service Delivery Strategy (Midway) as recommended by Liberty Consolidated Planning Commission. Councilman Clancy seconded the motion. This motion passed unanimously.

Amendment to Subdivision Regulations – Mr. Nils Gustavson, Chief Inspector, LCPC – Mr. Gustavson requests this item to be tabled. He will let us know when he wants to submit the Amendment to Subdivision Regulations.

Eastwood Village Subdivision Irrevocable Letter of Credit #164 – Mr. Gustavson request that this item be removed from the agenda until it’s completed. Councilman Doyle suggested that a scheduled date be given; Mr. Gustavson stated there was not a time limit.

New Business
Christopher Smith, a student from the Midway Middle School, presented a PowerPoint presentation on safety. He was concerned that there are no sidewalks leading to any of the schools; nor is there a tornado siren for evacuations. Chief Morningstar explained that the City’s Police Department is in the process of applying for a grant for sidewalks. Chief Morningstar asked Mr. Smith to serve on her committee.

Tree Ordinance – Mrs. Hartage presented the Mayor and Council copies of the changes. Mrs. Hartage stated the Tree Maintenance budget is reduced to 50% of the required tree points. Mayor and Council will hold all questions until May 24, 2010 work session.

C. C. Beverage, LLC – Transfer Location – Mrs. Debra Attical made the presentation stating the property at Butler Ave is zoned B-2. LCPC made a recommendation of approval. Mr. William Chevis, owner of the business stated he will have the same lighting the previous business used. Mayor Pro-Tem Roberts made the motion to approve the relocation. This motion was seconded by Councilman Clancy. This motion passed unanimously.

Envision Images Photography Occupational Licenses - Mrs. Attical made the presentation with the recommendation for approval from LCPC. Mrs. Shelia Fisher, the owner was present to explain the day-to-day operation of her business. Councilman Doyle made the motion to approve Envision Images Photography Occupational Licenses. Mayor Pro-Tem Roberts seconded the motion. This motion passed unanimously.

Council 2010 Goals – Mayor Washington and the Council made changes to the deadlines of the Goals. Mayor Pro-Tem Roberts made the motion to adopt the Council 2010 Goals. Councilman Clancy seconded the motion. This motion passed unanimously.

East Liberty County American Legion Post #321 – No one was present.

Announcements - Mayor Washington thanked everyone for coming and invited everyone to the monthly work session on May 24, 2010.

Adjourn – Councilman Clancy made the motion to adjourn the regular monthly meeting. Councilwoman Hamilton seconded the motion. This motion passed unanimously. The meeting adjourned at 8:10 p.m.
